1. Acceptance of Terms
By creating an account, purchasing a service, or using any product offered by Oryzen Hosting ("we," "us," or "our"), you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), have the legal capacity to enter into this agreement, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our services.
These Terms constitute a legally binding agreement between you and Oryzen Hosting. They apply to all services including but not limited to: VPS hosting (managed and unmanaged), game server hosting, bot hosting, web hosting, and related infrastructure services.
2. Description of Services
Oryzen Hosting provides infrastructure-as-a-service solutions. Our services include:
- Virtual Private Servers (VPS): Managed and unmanaged Linux-based virtual machines with root access
- Game Server Hosting: Optimized instances for Minecraft, Discord bots, and other game workloads
- Bot Hosting: Lightweight containers for Discord, Telegram, and automation bots
- Web Hosting: Linux-based environments for websites and applications
- Infrastructure Services: DDoS protection, network connectivity, and datacenter access
Service specifications, available locations, pricing, and features are subject to change. We will provide reasonable notice for material changes affecting active services.
3. Infrastructure & Network
Oryzen Hosting operates enterprise-grade infrastructure with the following characteristics:
- Service availability, performance, and features depend on infrastructure provider capabilities
- Hardware specifications (CPU architecture, storage type, network capacity) may vary by location and over time based on availability
- Network routing, latency, and bandwidth characteristics are influenced by global internet infrastructure
- DDoS protection is provided at the infrastructure level with enterprise-grade mitigation systems
We strive to maintain service consistency across all locations but cannot guarantee identical hardware or network characteristics in every region.
4. User Responsibilities & Account Security
You agree to:
- Maintain accurate, current, and complete account information
- Protect your account credentials and immediately notify us of any unauthorized access
- Take full responsibility for all activities conducted under your account
- Comply with all applicable local, national, and international laws and regulations
- Not use our services for illegal, harmful, fraudulent, or abusive purposes
- Not host copyrighted material without proper authorization or licenses
- Not attempt to bypass security measures, exploit vulnerabilities, or interfere with other users' services
You are solely responsible for the content, configuration, and security of your server environment. For unmanaged services, Oryzen Hosting provides infrastructure access but does not manage, monitor, or maintain your server's software, applications, or data. Managed services include varying levels of support as specified in your service plan.
5. Payments, Billing & Pricing
5.1 Payment Terms
All services are prepaid. Invoices must be paid in full before service activation or renewal. We accept payment via cryptocurrency (LTC, BTC, USDT), UPI, credit/debit cards, and other methods as displayed at checkout.
Failed payments may result in automatic service suspension. Services suspended for non-payment may be terminated after 7 days. Reinstatement may require payment of outstanding balances plus a reactivation fee.
5.2 Pricing Structure & Adjustments
Pricing is based on infrastructure costs, network expenses, and operational requirements. We maintain transparent pricing with no hidden fees. All prices are inclusive of applicable taxes.
Monthly Plans: Pricing for month-to-month services may be adjusted in future billing cycles based on changes in infrastructure costs, network pricing, hardware availability, or operational expenses. We reserve the right to modify pricing with appropriate notice as required by applicable law.
Commitment Plans: Services purchased with 6-month or 12-month commitments have pricing locked for the duration of the commitment period. After the commitment term expires, services revert to standard monthly pricing unless renewed.
Promotional pricing (e.g., discount codes like WELCOME10) applies only to the first billing cycle unless explicitly stated otherwise. Promotional rates do not carry forward to renewal cycles.
5.3 Taxes
All prices displayed on Oryzen Hosting are inclusive of all applicable taxes including GST. No additional taxes will be charged at checkout. The price you see is the price you pay.
6. Refund & Credit Policy
6.1 Refund Eligibility
Oryzen Hosting offers a limited 24-hour refund window exclusively for verified technical incompatibility. Eligible reasons include:
- Required Linux distribution not available on the purchased plan
- Critical hardware feature missing (e.g., virtualization support required for your workload)
- Location-specific latency making the service unusable for your stated purpose (with evidence)
Refunds are not provided for: change of mind, performance expectations not met, user configuration errors, or services used beyond the 24-hour window.
6.2 Service Credits
If a service disruption is confirmed to originate from Oryzen infrastructure (not user configuration), we may issue account credits at our discretion. Credits are issued as a goodwill gesture and are subject to internal review.
Credits are not applicable for: user misconfiguration, resource exhaustion, external provider issues, force majeure events, or scheduled maintenance with proper notice.
6.3 Chargebacks & Disputes
Initiating a chargeback, payment dispute, or reversal through your payment provider for services rendered will result in:
- Immediate permanent termination of all services associated with your account
- Permanent ban from Oryzen Hosting
- Potential referral to collections or legal action for recovery of funds plus administrative fees
If you have a billing concern, contact support before initiating a dispute. We are committed to resolving legitimate issues fairly.
7. Service Availability & Performance
Oryzen Hosting strives to provide reliable, high-performance infrastructure. Our target service availability is 99.9% monthly uptime for network connectivity and power infrastructure.
What's Covered: Network connectivity, power infrastructure, hardware reliability, and infrastructure-level DDoS mitigation.
What's Not Covered: User misconfiguration, software errors, resource exhaustion, external provider issues, scheduled maintenance (with 48h notice), force majeure events, or application-level performance.
We do not guarantee specific performance metrics (CPU speed, disk I/O, network latency) as these depend on workload, configuration, and external factors. Performance may vary based on location, time of day, and network conditions.
8. Data Protection & Backup Responsibility
8.1 Infrastructure Protection
Oryzen Hosting implements industry-standard measures to protect infrastructure integrity, including:
- Redundant power and network systems
- Enterprise-grade DDoS mitigation at the network edge
- Regular hardware maintenance and replacement cycles
- Security monitoring and incident response procedures
8.2 User Data Responsibility
Important: Oryzen Hosting provides unmanaged infrastructure services. We do not backup, manage, or guarantee the integrity of your server's data, files, applications, or configurations.
You are solely responsible for:
- Creating and maintaining regular backups of your data
- Storing backups in off-server locations (external storage, cloud services, etc.)
- Testing backup restoration procedures
- Securing your server against unauthorized access, malware, or data loss
In the event of infrastructure failure, hardware issues, or other disruptions, we will work to restore service availability but cannot guarantee recovery of user data. We recommend automated backup solutions such as rsync, BorgBackup, Restic, or external cloud storage.
9. Acceptable Use & Resource Limits
To ensure fair usage and service quality for all customers, you agree not to:
- Use excessive CPU, RAM, disk I/O, or network bandwidth beyond your allocated limits in a manner that degrades service for other users
- Run prohibited applications including but not limited to: crypto mining (unless explicitly approved for your plan), password cracking tools, network scanners, or exploit frameworks
- Host content that violates intellectual property rights, privacy laws, or community standards
- Attempt to bypass resource limits, exploit virtualization, or gain unauthorized access to other users' services
- Use services for spam, phishing, fraud, harassment, or other abusive activities
We monitor resource usage and network activity to maintain service quality. If abuse is detected, we may:
- Throttle resource usage temporarily
- Suspend services pending investigation
- Terminate services without refund for severe or repeated violations
10. Prohibited Activities
You may not use Oryzen Hosting services for:
- DDoS attacks, botnet command-and-control, or participation in attack networks
- Distributing malware, ransomware, spyware, or other harmful software
- Hosting illegal content, copyrighted material without authorization, or content violating applicable laws
- Cryptocurrency mining unless explicitly permitted by your service plan
- Spam, phishing, impersonation, fraud, or other deceptive practices
- Attempting to exploit, bypass, or interfere with our security measures or infrastructure
- Harassing, threatening, or abusing Oryzen staff or other customers
Violations of this section may result in immediate service termination without refund and permanent account ban. We cooperate with law enforcement and rights holders in investigating illegal activities.
11. Intellectual Property
All content, software, trademarks, and intellectual property associated with Oryzen Hosting (including but not limited to our website, control panel, documentation, and branding) are owned by Oryzen Hosting or our licensors and are protected by applicable intellectual property laws.
You retain ownership of content you create and store on our services. By using our services, you grant us a limited, non-exclusive license to host, transmit, and display your content solely for the purpose of providing services to you.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ORYZEN HOSTING AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to, use of, or inability to use our services
- Any unauthorized access to or use of our servers and/or personal information
- Any interruption or cessation of transmission to or from our services
- Any bugs, viruses, trojan horses, or the like transmitted through our services
- Any errors or omissions in content or for any loss or damage incurred as a result of use of content posted, transmitted, or otherwise made available
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to defend, indemnify, and hold harmless Oryzen Hosting, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Your use of our services, including any use of content, data, or information other than as expressly authorized
- Your violation of any third-party right, including intellectual property or privacy rights
- Any claim that your content caused damage to a third party
14. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by:
- Posting the updated Terms on our website with a revised "Last updated" date
- Making updated Terms available through our service portal
Your continued use of our services after changes take effect constitutes acceptance of the updated Terms. If you do not agree to modified Terms, you must discontinue use of our services before the changes become effective.
15. Termination
Either party may terminate this agreement:
- You: By canceling your services through the billing panel. Prepaid amounts for unused service time are non-refundable except as explicitly stated in our Refund Policy.
- Us: For material breach of these Terms, non-payment, illegal activity, abuse, or other violations as described herein. Termination may be immediate for severe violations.
Upon termination, you must cease all use of our services. We may delete your data and server instances after a reasonable period (typically 7-30 days) unless you export your data beforehand. We are not responsible for data loss after termination.
16. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or our services shall be resolved exclusively in the courts located in India.
Before initiating formal legal proceedings, we encourage you to contact our support team to attempt resolution. We are committed to addressing legitimate concerns fairly and efficiently.
